Code of Ethics


In furtherance of the VALUE STATEMENTS – lest it remain vague or nebulous – and in recognition of the privileges we have and the prerogatives we administer as a public trust, members of the CEMETERY AND CREMATORIUM ASSOCIATION OF BRITISH COL UMBIA will not practice or condone any unfair, unjust or unethical practices, including:

  1. Any presentation made in a manner or language, verbal or written, as to mislead or tend to mislead the public on the true nature of a cemetery or cremation transaction;
  2. Any representation that the interment space or rights, goods or services are offered at a special price to a particular person only, or for a limited period of time only, when such is not the case;
  3. Any offer of a discount on the price for interment space or rights, goods or services, whenever this price has been increased to cover such an alleged discount;
  4. An offer to anyone of free interment space or rights, goods or services, when accompanied by failure to disclose any material fact or condition of the offer, such as a requirement that other interment space or rights, goods or services be purchased, or by selling any of these above their regular price to compensate for the free items;
  5. Selling or attempting to sell any goods or services as though required by law, when such is not the case, as well as any other unjust billing, unusual fees, exorbitant charges, or non-uniform pricing within identical classifications;
  6. Requesting or accepting payment of more than the normal charge on the assumption that the person involved has the ability to pay the excess;
  7. Any offer to sell, or sale, of interment space or rights for speculative or investment purposes with, or upon, the express or implied promise or prospect of a resale in the future at a profit;
  8. Offering for sale or selling goods or services for future delivery, without procurement of these goods or placing in trust from the proceeds of these sales adequate (or required) funds to guarantee, without additional cost, delivery of the goods or services when required;
  9. Any misrepresentation as to the ownership or operation of the cemetery or crematorium;
  10. Exaction of commissions from operators of related or auxiliary services (as distinguished from reasonable charges for customary services actually rendered by the cemetery or crematorium to such operators, or for their use of cemetery or crematorium facilities) or the payment of money or other valuable consideration to any person for directing a prospect for a sale to the particular cemetery or crematorium;
  11. Encouraging the cancellation of a contract already entered into with another cemetery or crematorium, in order to make a sale;
  12. Misleading advertising, by whatever media or means;
  13. Requiring or accepting tips or other valuable consideration for service to a lot holder for which the lot holder was already entitled, or collusion with another person to the detriment of the lot holder;
  14. Any action, other than as permitted by law, that discriminates or appears to discriminate against any individual because of race, creed, colour or national origin;
  15. Any solicitation of sales, by whatever means or manner, contrary to legal prescriptions;
  16. Any solicitation conducted or repeated in a manner that may harass or appear to harass an individual, or knowingly soliciting again any individual who on a previous occasion had declined to enter into a purchase agreement;
  17. Any sales presentation or practice which conceals or misstates a material fact, thus tending to bring into disrepute not only the particular cemetery or crematorium but also all death care facilities generally.
  18. Any denial of responsibility by the owner or operator of a cemetery or crematorium for the statements made, methods used or other actions of sales persons or sales organizations in selling interment spaces, goods or services for the particular cemetery or crematorium;
  19. Any failure to comply with the terms of sales contracts, provincial or other applicable laws and regulations relating to cemeteries or crematoria, or other business requirements.
  20. Delinquence or negligence in one’s responsibility to be prompt and current in the payment of accounts incurred in the development, management, operation and care of the cemetery or crematorium.

Members of the CEMETERY AND CREMATORIUM ASSOCIATION OF BRITISH COLUMBIA, who violate provisions of the Association’s CODE OF ETHICS, are subject to disciplinary action as provided in the Bylaws; additionally, such members may be reported to the proper authorities for appropriate action under applicable laws.

For the protection of the consumer and to maintain the integrity of all providing death care services, the Association, when informed of illegal actions or unethical practices by non-members, may similarly report the matters to the proper authorities.
